1. Scope
For the business relationship between SHOPPERSTARS International AG, Sandgrube 29, 9050 Appenzell, Schweiz (hereinafter “SHOPPERSTARS”), and the customer via the online shop nui-vital.ch, these GTC in the version valid at the time of the order apply exclusively. Deviating conditions only apply with express written consent.
2. Conclusion of contract
The product presentation in the shop is not a binding offer but an invitation to order. By submitting the order, the customer makes a binding offer. The contract is concluded upon our order confirmation or upon shipment of the goods. The contract language is German.
3. Prices & value added tax
All prices are in Swiss francs (CHF). Shipping costs are shown during the order process.
4. Payment
The payment methods shown during the order process are available (including credit card via Stripe; further methods such as TWINT/PostFinance in preparation). In the case of prepayment, delivery takes place after receipt of payment.
5. Delivery & shipping
Delivery is made to the specified address in Switzerland and Liechtenstein. Delivery times are approximate values.
6. Retention of title
The goods remain the property of SHOPPERSTARS until full payment.
7. Warranty (defects)
The statutory warranty under the CO applies (Art. 197 et seq. CO). The customer must inspect the goods immediately upon receipt and report defects in writing without delay (Art. 201 CO); otherwise the goods are deemed approved. In the case of a justified, timely notice of defects, we will provide, at our discretion, rectification, replacement delivery or refund.
8. Right of return
In Switzerland, there is no statutory right of withdrawal/return in distance selling. However, SHOPPERSTARS grants a voluntary right of return; details are governed by the “Return” page. Opened or unsealed foods and food supplements are excluded from return for reasons of hygiene.
9. Liability
SHOPPERSTARS is liable for damages arising from injury to life, body and health in accordance with the statutory provisions. Otherwise, liability is – to the extent permitted by law – limited to intent and gross negligence. Claims under the Product Liability Act (PrHG) remain unaffected.
10. Applicable law
Swiss law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The statutory places of jurisdiction apply.
